Membership Agreement
1. The Member is entitled to use all of the facilities at Inspire Gym for the period stated, provided they are not in arrears in respect of any instalment due to the Gym, or that the user is not in breach of any other conditions stated within this Membership Agreement.
2. All terms and conditions of this Agreement apply equally to all persons on the Membership Agreement including guests, as if those persons were the Member, Membership is non-transferable.
3. Off peak Members are restricted to the use of Gym facilities between the hours of 9.00am and 3.00pm, Monday to Friday inclusive. The latest Gym visiting time for our off-peak Members is 2.00pm.
4. Unless the Member, four weeks before expiration of their current Membership gives Inspire Gym written notice terminating their contact, the same Member agrees that Membership shall automatically renew on the same terms. Membership cards are renewable at the time the Membership becomes renewable.
5. Membership payment and liability.
5a. Payment by instalments are due regardless of your Gym usage. In the event of a payment default, entrance to the Gym and the facilities will be declined.
5b. In addition, the Member will be liable for the full amount due as reflected on the face of the Membership Agreement. Not with standing that the company has agreed to permit the Member to pay the amount in due instalments. The Member accordingly agrees that if they fail to make payment on two instalments by the due date then the full outstanding amount:
bi. The Member shall become liable for the outstanding amount immediately.
bii. Shall accrue interest on the full outstanding amount at the prime rate charged by the banker of Inspire Gym from time to time.
5c. Should the company be obliged to institute legal proceedings against the Member arising from breach of terms of this Membership Agreement, including but in no way limited to their failure to pay any amount due by the due date. The Member shall acknowledge that they shall be liable for all tracing fees, collection commission and legal costs as mat be allowed by the court.
6. In unusual circumstances and at the Gyms discretion, the Membership can be cancelled by paying a cancellation fee (One months membership - the contracted monthly amount)
7. The Gym Membership can be terminated by the management for violation of any rule or regulation of the Gym as stated or advised from time to time, or for conduct reasonably by the Gym to be detrimental to the welfare, good order or character of the Gym and its Members. The Gym shall have the right to retain the money paid by the termination.
8. The company is not responsible for the loss of any personal items or damage to personal property, either on the Gym premises or in the Gym parking areas.
9. It is the responsibility of the Gym Member and/or the parents or guardians of children under 16 years of age to supervise their children whilst within the Gym premises. Admission and use of the Gym by children under the age of 16 is strictly prohibited due to insurance purposes.
10. Smoking within the Gym is strictly prohibited.
11. Special dispensations for facility usage.
11a. The company reserves the right to alter, change, add to, reduce or cease various Gym facilities and to utilise the Gym facilities for special events, tournaments or other activities it may deem desirable.
11b. Non-exercise facilities requiring additional payments for use or service may not be available to Members at all times or at all. The providers of these services set their own tariffs and trading terms.
12. By signature of this Membership Agreement the Member agrees that they and all persons covered by this Membership Agreement:
12a. Are physically and medically fit to proceed with normal routines of exercise and that the Gym will not be responsible for any injury, accident or loss suffered by the Member or any other persons or guests covered by this Membership Agreement unless such injury, accident or loss is caused by the negligence of the Gym or a Member of its staff.
12b. The Gym may withdraw use of all or part of each facility at the Gym due to the failure of services or for the undertaking of maintenance work, or any other work considered necessary. Compensation will not be given in such circumstances.
12c. If through circumstances beyond the reasonable control of the Gym it is unable to provide the full range of services and facilities as advertised, the Member shall remain liable for all Membership fees.
13. In the event of a major reconstruction of the Gym premises, every effort will be made by management to eliminate any diminution of the Gym services. Membership will not be suspended and Members co-operation in this respect is assumed.
14. The Member hereby agrees that they and all other persons or guests covered by this Membership Agreement shall use the facilities of the Gym entirely at their own risk and that the Gym shall not have any liability for any loss, injury or damage sustained to them or their property unless sustained due to a negligent act or omission made by the Gym or its staff. Members are required to observe the Gyms dress, footwear and equipment codes and the rules of the Gym as advised from time to time by the management of the Gym.
Use of personal information
We may use the personal information you provide for any of the following purposes: (1) To understand the use of our Gym and make improvements, (2) To full-fill prizes, (3) To respond to specific requests from visitors, (4) To protect the security or integrity of our site when necessary, (5) To send you notices and solicitations regarding the Gym, (6) In general to promote and market products to you. These solicitations may take the forms of mailings or other couriers, telephone calls, email and other methods of contact. If you do not want to receive these solicitations from us using your personal information, please notify us. At times we may conduct online surveys to better understand the needs and profiles of our visitors. When we conduct a survey, we will try to let you know how we will use the information at the time we collect the information from you on the internet.
Disclosure of your personal information
Unless otherwise disclosed during the collection, personal identifiable information that may be collected in connection with visitors to this Gym is retained by Inspire Fitness. Inspire Fitness does not sell, transfer or otherwise disclose this personally identifiable information outside of the Gym. Except where disclosure is required by law.
Data Protection
Banking details will be encrypted under the data protection act, no un-authorised personnel will have access to your personnel details.
